Day after day, motor vehicle accidents caused by texting and driving occur throughout the country. Even if you avoid this activity while driving, it doesn’t mean that others are doing the same.

Here are some important steps to take if you spot someone texting while driving:

  • Move out of the way: Don’t drive in close proximity to this person, but instead, create space in a safe manner.
  • Call 911: Upon pulling to the side of the road, call 911 to report the driver. Share as much information as possible, such as the make and model of the vehicle, color and license plate number.
  • Ask them to stop: This isn’t something you should do to a driver in another vehicle, as it may anger them. However, if the driver of your vehicle is texting, ask them to stop. Explain that it’s dangerous and that pulling to safety before texting is much safer.

Even if you keep your eyes open for distracted drivers, you could still suffer an injury in an accident. This should lead you to call 911 to request an ambulance. As you’re waiting, treat your injuries and collect evidence, if possible.

Once you receive medical treatment, contact your insurance agent to file a claim. When doing so, don’t answer any questions that make you uncomfortable. This can harm your ability to receive all the compensation you deserve.

As the victim in a texting and driving accident, you have the legal right to seek compensation from the negligent party. Don’t stop until you get what you’re entitled to.
