How do you fight a shoplifting charge?

A shoplifting conviction doesn't sound like that big of a deal but depending on the value of the merchandise, it can result in serious consequences that alter your life for many years to come.

For this reason, it's critical to do your part in fighting a shoplifting charge, as there are defense strategies you can use to get your charges dropped or reduced.

Here are some ideas to consider:

  • Challenge that you weren't shoplifting: For example, if you were confronted by security while you were still in the store, you can argue that you had the intention to pay for the item before leaving.
  • Challenge witness statements: Many shoplifting cases are built on witness statements, such as those from store personnel and/or security guards. You can challenge their statements, such as by poking holes in what they believe they saw.
  • Argue that you made a mistake: Maybe you were so busy checking out with other items that you forgot to put all of them on the counter. Or maybe you were distracted by your children, so you walked out of the store holding onto something that you had the intention to pay for.

You won't know which shoplifting defense strategy to use until you review the circumstances surrounding your arrest. At that point, you can begin to search for holes in the case that give you an opening to defend yourself.

Don't assume that a shoplifting conviction will come and go, as the consequences can be far-reaching. Protect your legal rights and do your part in keeping the charges off your record.
